Director of the Light youth theater Mikhail Ushakov got in touch with Zasekin

Exotic and still completely unclear the case of the theft of 106 million rubles from Rosneft through the Samara youth theater "Light" on the basis of an agreement between organizations reached the indictment approved last Thursday by the prosecutor's office of the city of Samara against Mikhail Ushakov and the Zuev brothers. All three defendants, called the group, are charged with a crime under Part 4 of Article 159 of the Criminal Code of the Russian Federation (fraud committed on an especially large scale). On the eve of the start of court hearings in one of the most high-profile cases of the year, our correspondent met with Mikhail Ushakov’s lawyer and gave his client several questions from Zasekin. And what’s more, I received very frank answers from Mikhail.

- Mikhail, you are under house arrest, you have a sensor on your leg. How does this thing work?
- Yes, there is a bracelet on my leg that was made by the Federal Penitentiary Service of Russia. How does it work? The guards in their office have equipment that communicates with the satellite phone in my apartment, which in turn connects with the bracelet. The guards said that this whole system of know-how costs a million, if I break it, I will return the money :)

The system shows where I am. Perhaps the device has wiretapping, and this opportunity At first I was very nervous, but then I got used to it. With the bracelet you can swim for 8 minutes, I even dived with it in the Volga, and once I fell asleep in the bathtub. Nothing, it works - it’s a million after all.

- What did you feel when all this happened, when the news about you went to the top of Yandex?

I didn’t know that I was in the top of Yandex. It’s funny, because over the past 5 years I have done a sufficient number of good socio-cultural projects, and I have never received such attention, but here there is so much “fame”. My sister told me that you can’t read anything good about me on the Internet. She said: “If you type “Ushakov”, “Light Youth Theater” into the search engine, there will be no projects or what you did, it will be about how you “robbed” Rosnfet.”

The parents said that there were practically no analytical materials on this case in the media, only dry notes, such as “the defendant Ushakov’s term of house arrest was extended for so many more months.” I know for sure that many media outlets were prohibited from publishing analytics on this case. In recent months, parents have contacted a number of Samara and federal media. Many refused immediately, there were also those who were forbidden by the editors, there are many examples. Journalists hold on to their seats.

- Besides you, the media immediately picked up the story about the Zuev brothers. How do you assess their role in this matter?

On the day I was taken into custody, they immediately asked me to testify against the Zuevs and go home. Give not my testimony, but the one that the investigator asked. I think they were immediately designated as scapegoats. When I was sitting in the temporary detention facility (temporary detention center), I was processed by the head of the 7th operational department of the department economic security and anti-corruption, Colonel Karyazin. He told me about how bad the Zuevs are, about their greed, that soon their business will be closed down along with their patrons. About the fact that Rosneft is far away, and it will go to Zuev and me if I don’t testify. I then read his version, almost word for word, from Mr. Trushkin, who published it on kompromat.ru.

I think that the Zuevs know a lot of names and surnames, and their mouths were closed. From the case materials, it is very obvious that Andrey Zuev made a deal with the investigation, and his mouth was quickly covered in the pre-trial detention center, and he refused to testify.

It is also obvious from the case materials that the role of the Zuevs is intermediary, but not organizational. There is no direct evidence. And I don’t believe that they convinced Rosneft employees over the phone to transfer money to the Light youth theater based on a scanned letter consisting of three paragraphs. It is important that Rosneft employees testified that the letter reached the office through the president of the company, and it was given to him by the former governor Artyakov with a request to support Samara projects. What an interesting twist, huh? So, if we talk about the role of the Zuevs, then most likely it is intermediary at the technical level.

I will be very curious to hear their testimony in court, it seems they are not going to remain silent there.

- There is a version that the case has political background, tell us about it.

IN at the moment I have familiarized myself with all 17 volumes of the case. About 30 important inconsistencies were found with the lawyer. Those. investigators took many small truths and created one big lie. I know that there was persistent talk behind the scenes that it was cashed out for the elections of United Russia in 2012. That’s why Artyakov’s name came up from the lips of Rosneft employees. Of course, he has nothing to do with the case. In general, there is a clear idea that the investigation spent 11 months covering the asses of some and, accordingly, fabricated a case against others. For example, in the first 15 volumes of the case we are mainly talking about the Zuevs, me and Chekmarev (ex-president of the Volga-Kama commercial bank - approx. ed.). As many as 3 volumes are dedicated to Chekmarev. And then Chekmarev was taken out of this case, and in April, while he was in northern Italy for treatment (they say he is in hiding), he wrote a manuscript against Zuev, his deputy Nazarov and me. This is exactly where the legs of a wonderful story grow, as if I came to him with a fake passport. There is no direct evidence, not even a photocopy of a fake passport. Immediately in April, the testimony of another bank employee appeared, which is funniest of all, the secretary Chekmarev and his wife :) Everyone says the same thing, supposedly there was a thin man in the bank who looked like a sectarian, and then they learned from the news that it was Ushakov. Until April, for some reason, everyone gave different testimony. According to my lawyer, Chekmarev was taken out for a lot of money. Consequence in profit.

So, as Colonel Karyazin told me, “This matter will not become political, but we will make you an ordinary idiot.”

- What does the theater have to do with it?Light, and what is the profit of such “non-profit” initiatives?

For me this was one of the biggest questions, because there is huge amount fly-by-night companies. I think because we had a reputation, we did a lot of projects, we were visible in our field. And, apparently, part of the money was actually allocated to the project, namely 24 million, which investigators found in Zuev’s accounts. The remaining 80 were not found, so I conclude that about 20 million should have gone to the project and kickbacks, and 80 should have been returned back. Having read the description of the project, I can say with confidence that the project would cost 5 million. I note that there is no estimate for the contract at all. So Light was not chosen by chance, and it seems that Rosneft really expected that the project would be completed and everything would be done well. But there was a glitch.

I will answer the following about profits and interest. Most often, it happens that a reputable company has funding for charity or advertising through the social sector, and the general director, for example, is involved in football or kick-boxing. Then sports federations or clubs are financed. That is, there is a personal interest here. In recent years, it has become popular among businesses to organize one-time or annual small grant competitions in various areas of activity. public organizations. And so on.

In my entire history of working in an NGO, I have only one successful long-term experience of cooperation with commercial organization. With ZAO Samara network company“We worked for 4 years, and everything was always transparent. We were checked by the company's security service and accounting department, they regularly attended events, and there were never any comments. They needed to establish, maintain and improve relations with the administrations of individual districts of the Samara region. Together we found a way to do this through the art-social project “Theatre Energy”. We trained and then supported volunteer teams, transferred technology to them, staged performances with them social topics, also showed their own performances in the districts. The local administration and our grantors came to the events. They met and strengthened connections, local media wrote about the cooperation of municipal structures, business, NGOs and youth. Here good example cooperation.

I would like to note that NGOs working in the same area know each other well. And, of course, sometimes there are rumors among colleagues about how a new non-profit organization has opened, most often funds for cash-out schemes. The meaning is this: when they give you 100 rubles, but on the condition that the projects are completed for 50 or 20, or 10. The rest of the money comes back. And then the NPO disappears. Is this a familiar pattern? Does it remind you of the Rosneft case? Just pay attention that the Light youth theater opened long before working with Rosneft and did not close immediately after, but continued to do projects until my arrest and even held a festival in November 2013. The case materials indicate that there was an audit of Light and all its sponsors and grant givers. Except for the case with Rosneft, “Light” turned out to be as pure as a baby’s tear - proven by the investigation :). Draw your own conclusions.

- How they work charities, which are in supermarkets?

I don't know exactly. But I don't really like this story. A professional joke - if you want to do charity, but don’t know how and with what exactly, then help sick children.

A person comes to a store, there is a pretty young lady or young man calling for help for sick children or collecting toys for an orphanage. Some begin to be gnawed by their conscience that they are not doing anything good for the poor kids, and they stupidly pay off with their money. Those. They don’t go to the orphanage, they don’t give the children their time and attention, they pay off.

Only a few funds in Russia open their accounting departments and make them transparent. There are unpleasant stories from the “Help Lerochka” series. How you collected more than you needed and spent it completely inappropriately. There are enough such cases and, thanks to them, in Russia there is a huge distrust of funds among the population. Specifically to the funds, because They are most often the distributors of money, the transfer point. It’s much cooler to support NGOs that create projects themselves and are as transparent as possible in their work...

Well, and finally, let me remind you about the idiotic laws on limiting foreign funding and foreign agents, which have squeezed many good companies.

- Why do you think there are longer sentences for economic crimes than for criminal ones?

The question is complex. An investigator told me that recently two employees of one of the Samara departments received a bribe of 80 thousand rubles and a camera, and then a sentence of about 7 years. But for robbery and murder they give less, sometimes 3-5 years. I don't know. Maybe because grandmothers began to value human lives more.

- Did people from Zuev, Rosneft, or the city administration contact you?

My lawyer communicates with the Zuevs’ lawyers, they exchange opinions. We have our own line of defense, which can diverge from other defendants. Why would Rosneft or the city administration contact me? I only know that in one of the city departments they urgently removed thank you letter from Light when the mess started :)

- How do you assess your chances of success?

What is success in this matter? If we talk about the verdict, I understand that it will be guilty. I am very disappointed in our judicial system, it serves and protects the interests of certain people. The Court of Appeal is generally a profanation. Having become familiar with mostly documents on your case, it became clear how easily you can introduce or remove the desired person involved, and decide the fate of almost any person. I understand that the prosecutor’s office, having looked at the case, will not say: “Where is Ushakov? Why is there nothing about him, what kind of linden is that?”

It may happen like this: people in power will tell the judge: “We need to give everyone an A” or “This one has so much, but this one...”. I hope that these people will come to their senses and reward me with a condition. I will be glad and even mentally thank them and wish them health.

And there is a high chance of remaining human in this matter.

-Are you ready for prison?

When I realized that I could end up in prison, I had a lot of resistance and rejection. I’m not drawn to it, I don’t see any romance in it, I have no interest in the life of a thief. The first four months were particularly hard on the idle time and lack of implementation. I wanted to do what I loved - social theater, but instead it seemed to me that I was wasting precious time locked up. But the arrest turned out to be a grandiose practice, and rethinking took place. As a result, I accepted that I could end up in prison, my worries went away, and I became much more peaceful. Now there are no such strong experiences and emotions as the first months of arrest. Ready for any court decision, especially a fair one.

- Did you imagine how you would enter the “hut”?

I was in a “hut” in a temporary detention center, I think that going into a “hut” in a pre-trial detention center is about the same. While working with Light, I carried out projects in pre-trial detention centers and correctional colonies, and there are certain ideas. “Hut” “Hut” is different. In the temporary detention center, I was assigned to two adequate men, one of whom explained to me the intricacies of being together and told me about life in a pre-trial detention center. So I was no longer imagining a “hut”, but rather what I would do in the colony if they gave me a real sentence. And if at first I was bothered by the thought - “how much?” What will I do in prison? And in general, “where is the justice?”, then at some point I realized that the place is not so important, what is happening is part of my path, I need to mind my own business. And I relaxed.
